1. Agreement to Terms

By accessing the Erebyx website at erebyx.com (the "Site") or joining our pre-launch email list, you agree to be bound by these Terms. If you do not agree, do not use the Site or sign up.

2. Description of the Email List

Erebyx LLC ("Erebyx," "we," "us," or "our") is developing an AI memory architecture. The email list allows you to express interest and receive updates. The email list is not a product, service, or subscription.

3. What the Email List Is and Is Not

• Joining our mailing list is free and voluntary
• Joining does NOT guarantee access to the product, early access, or any specific pricing
• Joining does NOT create a contract for any product or service
• We reserve the right to select email list members for early access at our sole discretion

4. Communications

By signing up, you agree to receive emails about product updates, launch announcements, and early access invitations. You may unsubscribe at any time via the link in any email or by contacting privacy@erebyx.com.

5. Your Obligations

• Provide a valid email address that you own or control
• Do not submit false or misleading information
• Do not use automated means to sign up for our mailing list
• Do not attempt to interfere with the operation of the Site

6. Intellectual Property

All content on the Site — including text, graphics, logos, trademarks, and software — is the property of Erebyx LLC or its licensors and is protected by applicable intellectual property laws. The name "Erebyx" and associated logos are trademarks of Erebyx LLC.

7. Disclaimer of Warranties

The Site and email list are provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Site will be available at all times, that our mailing list will result in any product being launched, or that information on the Site is complete or current.

8. Limitation of Liability

To the maximum extent permitted by law, Erebyx LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or email list. Our total liability shall not exceed $0 (zero dollars), as our mailing list is a free service.

Your use of the Site is also governed by our Privacy Policy.

10. Modifications

We may modify these Terms at any time. Material changes will be reflected in the "Last Updated" date. Continued use constitutes acceptance. We may also modify, suspend, or discontinue our mailing list at any time without notice.

These Terms are governed by the laws of the State of North Carolina, United States. Any disputes shall be resolved in the state or federal courts located in North Carolina.
